Legal Question in Family Law in Illinois

divorce

my sister's has been living with her husband for years wanting a divorce, she says he won't leave. He's not physically abusive but he is verbally and mentally abusive. She has 3 kids, two dogs and it is making them all miserable. She says there is nothing she can do, I say she can. What if anything can she do? They own a home in Elgin, Illinois.

If they live in IL, she can and must file for divorce there. However, from your question, it is unclear whether they live her, in GA, or there. Just owning a home in IL does not, by itself, establish where the jurisdiction is.
