Legal Question in Family Law in Illinois
Getting divorse wife may be mentally ill Help!!
my brothers marriage isn't going at all great. they are in the process of getting divorced, have a child, and all me brother REALLY wants is shared custody of the child. His wife is not clinically ''crazy'' but shows signs of being out of whack, and just today she started saying she wants full custody of the child and asks for my brother never to see the kid again, and she's threatening him, by saying if he tries to fight the custody, she'll tell the cops he has tried to molest the kid, which is horrible. she's starting to make all these irrational claims, and we are starting to think she is bi-polar or something. what can my brother do? how can he get full custody of the child? he didn't want full custody but after seeing what this woman is capable of we think its best for him to take the child with him.

The overriding rule here is the best interest of the child. That is what you need to consider. The judge certainly will. If its best that the child be with the father, then fight for it. Custody fights like the one your contemplating are time consuming and could be costly. False claims happen quite a bit, and the solution is to fight any such claims immediately and head on.
