domestic violence charges

I had my husband arrestted for 2 counts of battery last week. I no longer want to pursue the charges. How do I drop the charges before his court date on January 10 2007?

Hello. You probably will not be able to get the

charges dropped against your husband before the

court date. Your husband should have a lawyer

with him in court. If you do not appear in court, it is quite possible that the Assistant

State's Attorney will ask the judge to SOL

(Dismiss) the case that you filed against your

husband. However, there is no guarantee that

the Assistant State's Attorney will do this.

Assuming your husband was arrested by a police

officer, after the incident, it is possible that

the State may use the arresting officer as the

complaining witness. Of course, in either in-

stance it is important that your husband be in

court and have a lawyer present with him. I

will be happy to answer any additional questions
