Legal Question in Family Law in Illinois
Dometic abuse and custody
My ex and the father of my three children has just assaulted his new wife. He hurt her and destroyed property. She did not press charges. I am afraid to send my children to his home. Do I have any legal right or avenue to prevent our children from being alone with him?

Re: Dometic abuse and custody
Illinois law provides that a non-custodial parent has a right to reasonable visitation, unless a court finds that visitation would endanger seriously the child's physical, mental, moral or emotional health.
If you withhold visitation, you are at risk of visitation abuse. This does not mean you should send your children to visitation. Rather, you should consult a lawyer who will review the facts and advise you of your options. The well-being of your children may be at stake. Matters concerning minor children are one of the more serious and difficult matters of law, a field that requires capable conscientious counsel. I am confident there are many very skilled attorneys in your area who can meet your needs.
