Legal Question in Family Law in Illinois

Double-dipping my retirement

My ex will receive half of the marital portion of my military retirement. Anyway, the ex will get her ''cut'' of my retirement pay, and if I am correct, be paid AGAIN from this money for cs paid to our son who lives with her as cs is computed from my ''net income from all sources''. This seems VERY unfair to me. Is this true? If so, is there any recourse for me?

Re: Double-dipping my retirement

This is not double dipping. Rather, there are two separate dips .Her half share is an award of maritial property.

That share constitutes her dip.

The other dip is for child support. She is in actuality a trustee for the children to receive the child support for their benefit. Therefore, she is not personally benfitting from the second dip and in your terms is not double dipping.
