Legal Question in Family Law in Illinois

How Do I End Child Support When Child Turns 18

I have two kids and one of them will turn 18 in about 2 months. Do I have to get a lawyer to go back to court or will the deduction in child support be automatic?

Hello and thank you for your

question. I recommend getting

a lawyer and going to court

to reduce child support. The

actual legal term is "to abate

child support as to your oldest son." In Illinois the

statutory guideline for two

children as to child support

is 25% of your net income

per month. Therefore, with

the abatement of child support

as to your oldest son, the

child support should be reduced by 5%. Of course the

court may have obligated you

to pay other expenses above

and beyond child support such

as school costs, athletic

activities, etc. Now of course your son's mother and/or your son who has turned 18 can petition the court for

contribution to college

education based upon your

ability to pay, assuming that

he is graduating from high

school now. I hope my answer

has given you some insight

into the situation.

You should get counsel and return to court, particularly if you have been paying into the court with the checks then paid to your ex. The Court collection system will not know of the end of your obligation without a court order.
