My mother has just passed away and we were benificiaries to her retirment fund is this considered an estate. And do we have to pay her bills if we didn't probate the will.

Retirement fund payouts, like life insurance, are usually separate from the estate itself. You are not obligated to pay your mother's bills, but the estate may be obligated to pay them. Which bills are you referring to?
