Legal Question in Family Law in Illinois

?eviction?

My live in fiance of 4 and half years left our home 39 days ago with the children. Two days later she came with the police and they let her move items out of the house for about 3 hours. She has since changed her address and moved into her mothers house. I have not been allowed to see or talk to the kids since she left. I have requested to see or talk to them on a daily basis on her voicemail, but to no avail. How long do I have to leave the rest of her possesions here at my house or what do I do with them and how do I legally , I guess, evict her and keep her from being able to come back? Does she have any rights taht I should know about since she did live here with me for over four years? Thank you for your time in any help you can give me and any further information that would be helpful.

Since she voluntarily left, and there is a police record involved, you are in the clear as to keeping her out. Also, since she left there is no reason to keep her stuff, and in fact may complicate things if she lies to the police and says she still lives there.

As for the visitation issue, you need to go to court and get the proper court order. I highly recommend doing this asap, as the longer you want, the more your fiancee can argue that the children have "established a routine", which will make things hard for you.

Serve a 30 day notice on her, get a judgment, and have the sheriff remove her things.
