Legal Question in Family Law in Illinois

want ex-husband out of house

I let my ex-husband move into my rental house a little over a year ago and at his request added him to the lease. We have two minor children. Now I want him out of the house and he refuses to move out. I went today to get an emergency order of protection to have him removed and the judge denied it saying I was not in immediate danger. He sent my request back to divorce court and said my ex needs to be petitioned and divorce court needs to decide if he should move out. I have no resources for an attorney. Family Services of Dupage county said that divorce judges do not like to grant order of protections. Is there some other legal way to get him to move out without an order of protection? What will be the least costly thing I can do? A family service advocate helped me today but can't go into divorce court with me. I just want my divorced life back the way it was. I made a REALLY bad decision letting him back in my life.

Re: want ex-husband out of house

Your last sentence is correct. You made a choice to have him on the lease, and now your options are basically to move out and be responsible for the lease if he does not pay, or live with him.
