Legal Question in Family Law in Illinois
Hi, My ex-husband pay a set amount (20%) twice a month for child support based on "base" salary (he is in sales) and is supposed to pay 20% on any addtl' he receives above this amount (bonus', commission, meeting quotas', etc..) he told me prior to our divorce when first starting the job(he had previously lost a job and taken a $50,000 pay cut) that some of these "increases" are hidden in expense checks. It is now just about 3 years and he it appears based on w2's for 2011 and 2012, ( I received an approx. total of $800.00 over 2011/2012 for the bonus') and I have yet to receive bonus money for 2013 that he is still making close to his original base of $60,000 as a Sr. Acct Executive for a flooring company in the trade show exhibit industry (15 years experience in this biz) and he claims to have a "Project Manager" who works for him. I cannot find any salary info for this position.

If you take him back to Court on a Modification, or possibly a Motion for Contempt, you would be able to obtain all of the info you need through discovery. The practice question is whether or not it would be worth the expense in legal fees and costs.
