Legal Question in Family Law in Illinois
My now ex-wife and I have joint custody of my grandson. My ex-wife was only a step-grandmother. I let my grandson go visit her almost every weekend because he loves her. Every time he comes back from visiting her I have problems with his behavior. She doesnt make him go to bed at a reasonable time, he some times stays up until two AM. When he comes back it takes my girl friend and I three days to get him back to normal routine. Whem he is with me and my gorl friend he goes to bed at eight PM, he brushes his teeth and baths every night before bed time, eats good meals. Seeings how I am the biological grandparent and she is or was just a step-grandmother, would it be hard for me to get the Court to give me full custody of my grandson? Please help me, I am a disablked veteran fighting for my VA benefits and I am low income. Thank you.

ex-spouses do not make sensible joint custodians of paternal grandchild. Are you joint guardians or joint custodians. I am not sure that the law allows non-parents to be joint custodians - only parents can have joint custody. It may be that you are joint guardians - file a motion to modify order. Set forth the factual basis for the requested change.
