Legal Question in Family Law in Illinois
Father's Rights
My soon to be husband and I were considering taking his ex back to court to get custody of his 2 sons ages 10 and 12. Is it worth our time to pursue or do the courts tend to side with the mother?

Re: Father's Rights
You just can't change custody because you want to. You have to show that not only that its in the best interest of the children, but that the mother seriously neglects the children, or they're in danger with her.

Re: Father's Rights
I just finished a trial today in which I got the residential custody changed to the father, so it is certainly possible. The facts are important. In your question, you do not give any information for me to make an opinion as to your case. Feel free to provide more information.
