Legal Question in Family Law in Illinois

My fiance divorce was finally complete about a year ago. Their home (they are both on the mortgage) is currently for sale but the market is less than attractive right now. Does her ex have any legal right to keep me from moving in after we are married (assuming the home doesn't sell between now and then)?

It depends on what the judgment says. If your fiance is given exclusive possession, then it is probably all right. If he still also has a right of possession, it may be better to obtain court approval once you are married.
