Legal Question in Family Law in Illinois

Fiance's Child Support and Marriage

My fiance is currently paying for child support. I earn more financially than my fiance. Questions: If we get married, will the state compute the rate of child support payment based on both my and my soon-to-be-husband's combined income? How can I prevent this from happening? I have money in the bank that I saved long before I met my fiance and I placed aside for my son's future and I don't want it to be touched. Thanks.

Re: Fiance's Child Support and Marriage

Your fiance's child support obligations are his

and his alone. Under Illinois law, your income

cannot be considered as part of the whole pie. This needs to be handled very carefully. As to

your property, you and your husband probably

need an antenuptial agreement before marriage

so the record is straight on who owned what

before the marriage. If you have any additional

questions, I will be happy to answer them.
