Financial questions
Hi. My husband and I have been married 22 years, and have 20 and 16 year old daughters living with us. We've both agreed we want to divorce; he has told me to see a lawyer after the holidays because he's ''too busy to do it''. I plan on doing this. He has a well-paying job of 25 years; I've been a stay-at-home mom for most of these years. I earned a B.S. degree in Social Work in 2004. However, I need to obtain a Masters Degree in order to get a job where I can eventually support myself. Can I ask for my husband to pay my tuition for 2 years for the Masters Degree? Can I ask for him to pay medical insurance for me during these 2 years until I obtain my degree and get a job? Also, I'm concerned that he may take early retirement (he's 52) in 2007. If he does, how would this affect any maintenance or child support I could get? Should I file before 2006 is over, or should I wait until 2007? I don't want to jeopardize my finances by making the wrong move. Any advice is greatly appreciated. Thanks! Donna

Hi there. These are all very important questions. If both parties agree, reasonable terms can be put into the divorce decree and marital property settlement papers. Both sides are encouraged to seek legal counsel, but a party can waive their right to an attorney.
