Legal Question in Family Law in Illinois
I just found out I may need open heart surgery. I want to withdraw my petition for divorce but my husband has filed a counter petition and will not likely cooperate. I still filed a motion to withdraw anyway.............is there any chance a judge will grant it? If not, what will he do?
No children, no trial date yet and discovery requests have been served but not fulfilled by either party.

Your husband's counter-petition prevents the case from being dismissed. If you choose to do nothing, your husband could obtain a default judgment for dissolution against you, thereby finalizing the divorce.
