Legal Question in Family Law in Illinois

I have full custody if my daughter. Her dad and I were never married and we have no formal visitation set up through the courts. I am moving out of state (just an hour away) with my husband and kids and her dad has no problem with this. Do I need to petition the court to move since I receive child support, or because we were never married and there's no visitation schedule am I ok?

If there is a court ordered support order, you have custody. You should obtain a court order allowing you to leave the state,. If Dad has no objection, then it should be an Agreed Order. Absent that you are violating the law if Dad complains.
