Gain custody of nephew

My brother was granted sole custody of his 12 year old in Illois. The mother did not contest. Since then, the child has lived with his aunt and uncle in Illinois for 18 months and now with us, another aunt and uncle, for 2 months in Georgia. Father is an alcoholic and drug user who has multiple DUIs, no valid drivers license and is on food stamps. He now wants to take the child to live with him. How can we go about getting custody of my nephew? He said he would refuse to live with his father.

You should consult with a local attorney. Since the child is in GA, the GA court may have jurisdiction to entertain a guardianship case.

Hello It will be necessary to become a party in

the case and to do this you must file a motion

to intervene. This is a complicated procedure

and you need representation in the Illinois

court. Otherwise, the court will rule that you

do not have standing to seek custody of your
