Gaining Custody

I would like to gain Custody of my 7 year old son.My Mother filed for custody\guardianship. In her petition she stated that she had knowledge of my or my son's motherwhereabouts. This was false. Can I get the Courts decision overturned and initiate new proceedings? What's my best course of action? My son is doing poorly in school and seems sad all the time.What can I do?

It is a basic principle of American jurisprudence that courts should not interfere with a parent�s custody of their children, unless there is a serious reason to do otherwise. If custody of your son was obtained by your mother based upon false allegations and without notice to you, you should be able to have the matter reconsidered by the court.

You should not delay in seeking the advice of a lawyer. Custody of minor children is one of the more serious and difficult matters of law, a field that requires capable conscientious counsel. I am confident there are many very skilled attorneys in your area who can meet your needs.
