does an ex girlfriend have the right to stay in my residence if I am the owner ? She has been living there for 5 years.

This is more of a Landlord/Tenant law question than a Family Law question. If you were never married then your residence would not be considered the "marital residence". But, if she has been living there for 5 years she may have certain rights that you should be aware of. If you live in Chicago you should review the Chicago Residential Landlord Tenant Act. Copies are available at all city libraries and other city offices. Maybe you should consider giving her a written notice of your intent to terminate her lease. Thereafter, if she refuses to leave, you may have to pursue a forcible detainer action in court.
