Legal Question in Family Law in Illinois

Grandchild custody for medical insurance

My grandchild lives with me and I support 100% of living expenses. Also the mother of the child lives with me. I claimed the child on my income tax as a dependent. My medical insurance says I need a court order for insurance. What do I have to do to get these papers and what is it going to cost me. Thank You

Re: Grandchild custody for medical insurance

Hello. More and more grandparents are adopting their grandchildren. That is a trend that I have seen here in Illinois for the last 10 years.

I have represented grandparents in adoption cases before. You may want to consider this option. Clearly your grandchild's medical coverage would no longer be an issue. Dad will have to be notified, and if his whereabouts are unknown, you can do a publication which will constitute constructive service of process. The cost will vary; $1,500 to 2000 attorney fees, plus cost of about $500. If one of the parents

opposes you, naturally the attorneys fees will

be more because you will then have a contested

adoption. If the mother does not object, this

process should go very smoothly. I will be happy

to answer any additiona questions that you may

have.
