Legal Question in Family Law in Illinois
The grandmother has sole custody of my child. There is a support order in place in illinois and I provide medical insurance. There is nothing in the order stating I am responsible for any additional costs outside of biweekly child support and supplying medical coverage. I recieved a dental bill for the balance after insurance payment was applied. When inquiring at the office s to why the bill was sent to me rather than to the grandmother, I was informed that the grandmother (who authorized services and chose to go outside of the network) had informed the office that bills should go to me. I never signed treatment authorization or financial responsibility forms. Can the office make me financially responsible because they were simply told to? Can they continue to list me as being responsible even after presenting the office with the support order? Who should they be billing? What legal avenues are there for me to pursue?

You can waste time and money going into court to fight this issue but in all likelihood you will lose. You are the Dad and you were ordered to provide medical coverage. That may or may not include the unpaid medicals. G/M should not have gone outside the network and you should probably bring this to her attention for future occasions. Consider, however, the difference in costs if this dentist had been in the network. It might not be worth it to make an issue of it. Best advice is to pay the bill no matter how much you resent it and consider it the price of being a parent.
