Legal Question in Family Law in Illinois

Grandparents'Rights to Custody

My son and his live-in girlfriend recently insisted I take in my 6 month old grandson saying they could no longer handle him. The girlfriend wants to take him back later this week , but my son told me to keep the baby because neither of them wants him back. She is very mentally and verbally abusive to the baby and neglectful to his needs. My son cannot take care of a child. What can I do? I want to keep my grandson. Does my son have the right to give him to me permanantly ?

Re: Grandparents'Rights to Custody

He cannot "give" you a human being without the state getting involved. And the process is not simple since the other biological parent is not agreeing. YOu will have to go to court and show that the mother is unfit, which is a tall order. Verbally abusive to a 6 month old sounds iffy. Your going to need to show more than that most likely. Remember that taking away a parent's right to their baby is a serious matter.
