Legal Question in Family Law in Illinois

Guardianship of grandsons

Both of our grandsons' parents are in jail for felony drug charges. We are interested in giving our grandsons a stable home with us. I believe that the father is not on the birth certificate and our daughter has no problem signing them over to our care. We are not rich and wish to spend more on the boys than legal fees. Is there a way to get a general form granting us legal guardianship of the boys and where would we get that from? The parents both have at least two class X felonies each so I think we will be raising the boys. Thanks.

Re: Guardianship of grandsons

Hello. I know that you may have a budget that

you feel may not support legal representation,

but I suggests that you talk to a lawyer prior

to trying to represent yourself. Even though

your grandchildren's parents are incarcerated,

the court will still require that you proceed

according to court rules. Trying to represent

yourself can be difficult. A lawyer can save

you time even though you will have legal fees.

In the long run you will save money by retaining

an attorney. The process of obtaining a guardianship of your grandchildren begins in the

Probate Division of the Circuit Court. However,

I again stress that this is not a place where

you should try to represent yourself. I will be

happy to answer any additional questions that you

might have. I hope my answer has been helpful.
