Legal Question in Family Law in Illinois
guardianship
My sister is 51 years old and just spent 3 weeks in the hospital for medical neglect and is now being transfered to a nursing home, . this is the second time that this has happened. Both times upon admittance to the hospital she was near death. She has diabetes, hypertension, lymphadema and a large wound the size of a saucer that is yet to heal, she is also immobile and her mind is not all there. Both times all of these things have occured while her 19 year old son who lived with her did nothing, mostly because he is just clueless, we think he might be A.D.D and unable to make a wise decision behalf of his mother. He is also diabetic and had been neglecting himself also. We stepped in and was able for the 3rd time get him on the right track with his insulin shots and diet. I have 3 other siblings and we have been making sure that she gets the care that she needs, my nephew is ok with this, as a matter of fact he'd rather we do it. I know that my nephew is her next of kin, can How do i get totalguardianship over my sister?

Re: guardianship
You need to petition the court. I have handled several cases similar to yours; essentially your attorney will have to show the court why its in your sisters best interest for you to become her guardian and for you to explain how its going to work on a day to day basis.
Does your sister receive any benefits or income from any sources? Does she have assets? Contact me if you would like to discuss this further.
