Legal Question in Family Law in Illinois
Health Insurance For Minor Child Who Turns 18
My fiances divorce decree states that Husband shall maintain medical insurance on the minor children. My fiances daughter just turned 18 in May 2003. Until now, he has maintained medical insurance on his daughter through his ex-employer where he retired at no cost to him. On June 9th, 2003 he was notified by mail that his ex-employer will continue to cover his medical benefits at no charge to him, however, they will no longer cover dependents unless you want to pay the premium. From what I have read, it seems he has no legal obligation to pay for his daughters medical insurance now that she has turned 18 and has reached the age of majority. He would like to keep her covered since his medical plan will allow it, but he wants his ex-wife to pay for half the premium but she is unwilling and claims it is his ''obligation''. The question is this. Now that his daughter has turned 18, is he legally obligated to continue to pay for medical insurance for his daughter. I would appreciate any help you could give. Thank you.

No, he is not legally responsible.
