Legal Question in Family Law in Illinois

Hello,

I left my kids and wife over a year ago in Alaska and moved back to Illinois. Since then she moved to a different state with the kids and I can't locate her to be served divorce papers. How can I get my divorce granted with visitation rights?

Bottomline: You can't.

You can file in Illinois but the court will not have jurisdiction to grant the divorce until your wife has been served. Even then it will not have jurisdiction over the children because the children do not reside in Illinois. Only the State where the children reside can determine the custody and visitation issues. You may need to hire a private investigator to determine where your wife and children are currently residing.
