Legal Question in Family Law in Illinois
What can I do without hiring a lawyer, to have my child support increased to coincide with my child's father"s pay increase?
1 Answer from Attorneys
It is always advisable to hire an attorney to handle your legal issue. In Illinois, child support is usually based upon guidelines that are set forth in a statute. For example, for one child the guidelines state you should receive 20% of the father's net income per pay period. For two children it increases to 28%. For three children 32%, and so on. If you feel you are not receiving the proper amount and that the amount due would be considered a 'substantial change of circumstances' in the view of the court, then you may be entitled to an increase. On the other hand, if the father's income has dropped significantly since the entry of the support order he may be entitled to a decrease. It works both ways. I would suggest you contact either a lawyer, or if you are in Cook County, you could contact the Child Support Enforcement unit at 32 West Randolph in Chicago.
