Legal Question in Family Law in Illinois
My husband would like to adopt my daughter from a previous relationship.
''Baby jane,'' my daughter has no (legal)relationship with her bioligical father. He occasionally sends child support (that has been set up through the state) but does not provide any other support such as insurance or day care costs, etc. He did sign her birth certificate, but no visitation has been arranged. My husband would like to adopt ''baby jane,'' what is the first step that we need to take and how long can the process last.

Re: My husband would like to adopt my daughter from a previous relationship.
The father can still put a damper on this happy event but that shouldn't stop you from pushing the matter forward. I do adoption work, about 30 a year now a days. I would file a petition for adoption with your husband and yourself as petitioners. I would serve the father as defendant and the court would appoint a lawyer for the child to make a recommendation to the court separate from either of the parents' wishes.
If you could prove that the father has done little or nothing to be involved with the child than it should be an easy case. I charge $250 per hour plus costs. On an uncontested case the total fee is generally between $1250 and $1750.
I love this type of work so call me if I can help you.
