You have some serious questions here. First, settlements received during your divorce (especially as a result of something that occurred during your divorce) is marital, he gets half. Have you spoken to an attorney in regards to your injury yet?

As to the home, I would have to get a little more information, but he would likely not receive any part of the home but may be entitled to get back money that he put into the home. From the sound of it you need to be careful as when you accept a a settlement, and what you are allowing your new husband to pay for.
