Legal Question in Family Law in Illinois
My husband had an extramarital affair which resulted in a child. We have sent money and gifts to the child. He now received a court date from Illinois, we now live in Texas. I am concerned as we have 4 children, 2 of them I had before we were together, I am not working and he makes $11.25 per hour. I have hear all types of horror stories, so I am writing in hopes to get some advice on how I can protect myself and my children. I've read the courts do not take into considerations any other factors other than his income and the mothers income, but what about the children he and I have? And even though my older two children are not his, he still financially supports them, we all live in the same house and he has been their "father" for 8 years. He has also expressed interest in visitation with the child, he is almost 2, we just found out about him in November 2008. I know I'm rambling, I just need advice on what I can do to protect my interest. Thanks.

The first thing your husband needs to do is insist upon a paternity test for confirmation that the child is his. Aside from that you really need to to contact a legal aid attorney because this is one of the horror stories that you've heard about and it made worse by the fact that your 1200 miles away. Run don't walk to an attorney.
