my husband filed for divorce accusing me of physical and mental cruelty and has an order of protection against me because we were arguing and i yelled at him. He is also asking for sole custody of my kids. I have been to therapy and diagnosed with depression. My husband has been violent with me and it is on my psychiatric record. Discovery closes on may 9th and trial is June 18. what is a good defense?

Did you petition for a 604b eval? What does the GAL/Child Rep report say?

Few lawyers would or should take a case where discovery closes in two weeks, it appears to be a contested custody case, and the trial date is less than 60 days away. The best defense is a reasonable settlement, especially for the kids of both of you. What is in your psychiatric record is not admissible. It is not a good idea to ask that your psychiatric records be admitted into evidence (they may well not be appropriate evidence) The issue is who is the better parent now, not past conduct.
