Legal Question in Family Law in Illinois
My husband filed the initial Petition for Dissolution of Marriage where he was the Petitioner and I am the Respondent. I've completed the Answer/Response to that Petition as the Respondent. If I file a Counter-Petition, do I become the Petitioner on my Counter-Petition or does he remain the Petitioner regardless?

Hi, thanks for writing in. I practice in Missouri, but I'm pretty sure that in Illinois (as in Missouri) you remain the Respondent through out the divorce process. Hope this answer helps.

You are the Respondent/Counter-Petitioner, but you can not file the counter petition if you filed your response, unless you first obtain court permission to do so.
