me and my husband are filling for divorce, we have to kids together we have been separated for 9 months, he doesnt pay me child support, and just moved out of state without telling me, can he do that.....

Well, he can clearly move out, since you state he did it. He is responsible for child support and possibly maintenance, but you have to go to court for that. The sooner you ask the court for money from him, the sooner you will receive it.

He can live anywhere he wants. There is no proceeding pending. The only time a person is legally limited in his/her ability to leave a state is a custodial parent after a divorce case is filed. However since he has already left the state he has a hard argument that you should not also be able to leave.
