Legal Question in Family Law in Illinois
My Husband left the house. i actually told him to leave but i immediatly apologized and told him not to leave. he didn't care and he was in such a hurry to leave that he never came back for anyof his stuff. i have begged him to come back tons of times but he refuses to talk about us getting back together. i am pregnant and he left me alone when i need him the most. i kicked him out because he lied to me saying that he went to work when i had called work and they said that he didn't work that day. i checked his phone and he was talking and texing the whole world but when i called he wouldn't answer and lied to me saying his phone wasn't working when his phone was a week old. he wa also texting a girl i know that she had feelings for him. of course i was going to get mad. he doesn't want to be with me. i just want to know if i can get full custody of the baby and get him to pay child support at well. the problem is that he has never been able to hold a steady job and half of his jobs he has been paid cash for. he has nothing to offer this baby. he lives with his parents with no job. i have a good paying job and my own home with a baby room already set. Can i get full custody and have him pay child support even though he isn't working?

He has a duty to contribute to the support of the child. If he is not working the Court can order him to look for a job. it may also order him to contribute to the support of the child on a needs basis.
