Legal Question in Family Law in Illinois

My husband lives on Guam (US Territory). We have been in and out of contact for over 2 years and I have lost contact with him again. How do I get a divorce from him if I don't know where he is exactly? He left the States in April 2009.

If you make a reasonable effort to attempt to locate him and are unable to do so, his last known address is sufficient to allow you to get a divorce. You can serve him by publication and obtain a divorce.

If you live in Illinois and truly do not know where he lives or how to contact him you may be able to serve him by way of publication. In addition to your petition for dissolution of marriage you would include an affidavit as to military service and affidavit for service by publication. If you file at Daley Center the publication desk is located on the 8th floor where you would also file your divorce. You should probably consult with an attorney, or the folks at CARPLS, before filing. Good luck.
