Legal Question in Family Law in Illinois
My husband and I are married with 2 children in elementary school and live in Illinois. Every year my parents' go to their home in Arkansas for Thanksgiving. This has been going on for years. Many of my relatives join them for Thanksgiving. Even my 89 year old grandmother lives there. Before we were marreid my husband had joined us there for Thanksgiving. He is fully aware that this tradition has been going on since about 1988. However, he does not want to go for Thanksgiving this year and says I cannot take the kids there. I told him he does not have to go but I want to take the kids to Arkansas for Thanksgiving since they have never been. We will only be gone for 5 days. He says he will call the police and issue an Amber Alert if I take them to Arkansas for Thanksgiving. Can he legally do that? Do I have any legal right to take the kids for a vacation?

Of course you can go. You can also take your children. I doubt very much that any competent police officer would take a complaint and, if so, that an Amber Alert would be issued. As long as the two of you are not legally separated and there are no court orders entered restricting travel with the children, It sounds like he just tired of spending Thanksgiving with your family every year. Maybe you should stay home and start your own family tradition with your husband and children here.
