Legal Question in Family Law in Illinois

My husband and I are going through a nasty divorce. He is a very controlling and dominating person. I have been trying to put myself through nursing school in order to be able to take care of my 4 children. He just discovered that at some point (several years ago) I added his name to one of my student loans in order to be able to get it. I was not trying to be fraudulent. We were married, it was household income, we were not even contemplating divorce at that time. My whole intention was to repay my student loans - myself. Unfortunately, he is now threatening me. He is saying he will turn me in for fraud and have me arrested if I do not give in to all his divorce demands. The problem with his divorce settlement is all he wants to give is the minimal child support and NOTHING else, and he wants no debt. I need more money in order to care for my children. My lawyer says I am entitled to alimony since we were married almost 20 years, as well as some of his pension, and such things. I am afraid my hands are tied. Either my kids and I be poor and end up on welfare, or I go to jail??? Please help, can he do what he says he will do? Am I going to get into trouble? I did not mean anything bad or illegal!

1 Answer from Attorneys

You have an attorney and this is clearly a matter related to your pending divorce. It would be inappropriate for anyone here to comment on it without your attorney knowing. However as non-legal advice it seems you have a difficult time talking to the right person about the right thing, or not telling people things you need. You need to tell your attorney everything otherwise he or she can't really help you. Seeking help without discussing it with your attorney could undermine your own attorney-client relationship. If you don't trust you attorney, however, that's a completely different thing.
