Legal Question in Family Law in Illinois
my ex husband was ordered to pay me $550 a week permanent alimony, he was held in contemp of court for not paying attorney fees and medical bills as ordered, then he got three months behind in payments due to lay off, the judge then ordered $400 a week plus an additional $150 to make up the rest. he was laid off again for 3+ months and is refusing to make up those payments, can I take him back him court again, he seems to think because it was a lay off that this means he doesnt have to make that up to me. He never went to court to ask for a reduction. Does he have to pay this back, I need to know because he is going to put me behind in bills every winter, when he can work side jobs to support himself , which i proved at the last court case. Since i proved it by a cancelled check, business flyer and business cards that he puts out all over town, wont the judge make him make up those payments again.

This is a big enough case that you should see a family lawyer and keep hauling the deadbeat ex back before the Court so he can try out his lame excuses before the Judge and get hammered again and again for them. Increasingly sever contempt penalties seems likely, until the message gets through to him. Don't put up with his BS. Lawyer fees will probably be awarded again. If your ex is making that kind of money, he probably has assets than can be seized to collect the debt or an employer or bank accounts that can be garnished. Get off lawguru and get yourself to a local family law attorney. If the one you used last time isn't getting the job done, get one who can.
