My husband and I want him to sign my sons birth certificate but want know if we get divorced will he have to pay child support even though he is not the father and my son is from a previous relationship?

Signing a birth certificate when you know your not the father is illegal. Also, a birth certificate has absolutely nothing to do with determining who the father is. You and your husband will need to adopt the child, through what is referred to as a 'related adoption'.
