Legal Question in Family Law in Illinois

My husband and I have been together 10 years, married for 2 1/2 years, 2 kids together. Before we were married, I purchased a home. He contributed nothing to the down payment and the home is solely under my name. He has contributed to the mortgage payments. If I file for divorce and sell my home, is he entitled to any profits from the sale? What if I waited til after the divorce was finalized?

You're making the dangerous presumption that he won't be entitled to contribution. Irregardless, once you file for dissolution in Illinois, on the summons there will be big bold words preventing either party from liquidating ANY asset until the division of the marital estate is final.

In English: You won't be allowed to sell the home without leave of court or your ex's permission.
