Legal Question in Family Law in Illinois
Illinois alimony law
My wife and I are probably divorcing.
I am trying to
determine what is fair for us to
expect in alimony
requirements.
I make 100,000 she makes 42,000.
We have no shared property
other than a car which I will give her.
We have no
children. The living expenses for us in
the city are high
and I am concerned about her ability
to afford everything
her and still be able to eat out and
buy the clothes she is
used to but also am not sure what is
fair to provide her. I
am wondering what legally is
required/normal. We have been
married 4 and a half years.
thanks,

Re: Illinois alimony law
Since maintenance is not a set percentage or number in IL, it all depends on the facts of the marriage. Length, county, debts, assets, and more.
Generally, in Cook County, any long term maintenance is frowned upon. And if the marriage was short, probably none.
Re: Illinois alimony law
It really depends on the circumstances but I would venture a wild guess that you might not have to pay alimony. Things that are taken into account when determining alimony are whether she sacrificed her career to take care of the children and the length of the marriage. Here you have a short term marriage and she never sacrificed her career for the family.
Also, in the case that a judge would determine that you should pay alimony, it would probably be temporary and just enough to get her back on her feet.
