Legal Question in Family Law in Illinois

Insurance for children after divorce

Hello,

After my divorce (in IL Dec 2005) I carried the insurance payments for our 2 children until the cost became too much for me (I am the custodial parent) then I went to a lawyer to have my ex pay. He would not sign the paperwork or go to court but verbally agreed to pay the insurance. He did so for a time then told me he had cancelled it with a 2 week notice. I am still not in a position where I can afford to pay for the insurance and my children have been without insurance for over 4 months. Thank God they have not needed it but I would like to know if he is obligated by law to pay and if so how do I file the paperwork without paying a retainer to a lawyer. The last time I had to pay a lawyer a retainer of $2K I simply don't have that now.

By statute, you can hire an attorney and have your ex pay the bills. Let me know if this helps

He is not required since he did not agree in writing or sign anything. If he says he did not agree, then you are stuck. He will likely say he did not agree. You need to go to court and petition the judge to require him to provide it.
