Legal Question in Family Law in Illinois

interferring with court order

My husband has a court ordered visitation agreement with his daughter's mom whom he never married. She decided to move from Illinois to Indiana and it's about a 4-5 hour move. He is supposed to have his daughter every other weekend but because of this move it's going to be very difficult for us to go get her on Friday night and then drop her back off on Sunday by 6pm. Is there anything he can file to make her mom have to bring his daughter to us since SHE was the one that decided to move? Isn't that kind of violating the court order? Need answers soon. thankyou.

Re: interferring with court order

You need to go back to court immediately. Depending on the original court order, she is most likely required to ask the court's permission to leave the state. At any rate, you must petition the court for help before she moves.
