Legal Question in Family Law in Illinois

Involuntary Ternimation of Parental Rights

How easy would it be to terminate the parental rights of my son's father & filing child abaondment against him. He hasn't seen him in over a year & has given child support very few times in the past year. He is a drug addict & an alcoholic. He is a violent person & cannot be trusted. My husband now would like to adopt him also.

Re: Involuntary Ternimation of Parental Rights

If a parent has no contact with the child in 90 days, it may be considered abandonment. However, in an adoption, your son's father must be notified of the adoption.

Given the facts you presented, it is possible to terminate his rights, and do the adoption, but it will require some court appearances and some fighting. If the biological parent is ok with the termination (he might like not paying support anymore!), then the process will be easier.

If you would like to go over the details and provide more information as to the particulars of the biological father's actions and your location, feel free to contact my office.
