Legal Question in Family Law in Illinois

I haven't been involve in my ex-girlfriend pregnancy and she is certain that it's my child but she said she is not putting my last name due to the fact I haven't been around. Can she do this?

Yes and No. In order for you to put your name on the child's birth certificate, one of two things will have to happen assuming you don't marry the mother prior to the birth. At the time of the birth you both will need to sign a "voluntary acknowledgment of paternity" or 2) after the birth you file a paternity action in the circuit court asking to be declared the father of the child and to have your name put on the birth certificate. You best course of action, I think, is to wait until after the child is born and ask for a DNA test before committing yourself to paternity.
