Legal Question in Family Law in Illinois

joint debt in divorce

In 2002, we divorced, my ex and I split a $90,000 debt equally.

After the fact, I find out $31,000 of

his $45,000 half is on a Master Card with me listed as a joint holder. The company will not take my name off the account stating he cannot support the debt himself.

It has been almost 6 years. He has paid only $2000 and is making regular minimum (for the most part) monthly payments. The account has been closed. Do I have any legal recourse in this matter. I understand, if he defaults or dies, I am responsible. That would mean I would basically pay $75,000 out of the original $90,000 debt. Please help if you can. Thank you so much!

Re: joint debt in divorce

You can go back to court and get an order forcing him to refinance his debt to take your name off.
