joint parenting decisions

Hi,

My ex and I have joint parenting of our 6 y/o Daughter. She is currently attending a private school, but I want to have her attend a public school that is rated well. Also, I can't afford private school anymore. Does my ex have a say or can he prevent me from changing schools? He keeps wanting to discuss things when I already wrote it our for him my reasons. He likes to argue and disagree on everything I say. I am 28 weeks pregnant and cannot deal with the stress of him right now. I was remarried last year too.

Well it may depend on exactly what the joint parenting agreement says. Generally, you guys must attempt to mediate areas of disagreement and if you can't come to an agreement, then the Court decides. So I would start by requesting in writing that if you disagree we need to set this for mediation. See what comes out of that and then if necessary ask the Court to intervene. There are some pro bono mediation options with the Mediation Council of Illinois if you need some help there. Alternatively, if you can't pay there's likely not much he can do to you to enforce the private school provisions if you don't pay. But be careful, a court could give him a $$ judgment against you for the amount of private school tuition that you don't pay.
