Legal Question in Family Law in Illinois
If there is nothing in a JPA about make up dates do I legally have to give them? My agreement simply states that both parents are entitled to vacation with the children. It only requires relevant dates, address, and contact numbers. He sent a hostile voice mail and threatening letter demanding make up time. He never "requested" the time. It has all been accusatory and argumentative. Even threatening me that if I do not give him what he wants he will have police citations for me. All of this is in writing. The way I see it is we are both entitled to vacation with the kids. If he choses to take them on vacation then the days his vacation run into "my" time would equal out those that my vacation would take.

It appears that there are two issues; make up visitation and vacation time. Joint Custody is about agreeing to issues of medical, educational and religious for the children. Child support and visitation are separate though defined in the JPA. If the parties cannot not agree then there is probably a mediation provision in the JPA. Even if there is not a mediation provision, if there is a dispute about visitation then it is likely the judge would send you to mediation.
