Legal Question in Family Law in Illinois
Judge - Area of authority, both partys agree
The judge overseeing the case is a phaternity judge. Both partys agree to the same thing. Biologycal father volunterily terminating rights, if mother waivers rights to child support. But the judge himself will not allow it. There has always been the same father figure in the childs life. But not the bilologycal. The biologycal father has no relationship with the child whatsoever by his own choice. There is back due child support of almost $3000 that the mother is willing to forgo if he terminates rights. Both parties agree to the terms but the judge will not alow the termination of rights. Is there anything that can be done with this issue? Or possibly request a different judge?

Re: Judge - Area of authority, both partys agree
The right to support is the child's that is why the judge will not let it go. If the father figure was to adopt te child the biological father's rights could be terminated. The issue of support could also be addressed in the court once termination of his rights are taken over by te fater figure. I can help with the adoption of the child.
